Appeal to the Prefect of Pisa

Procedure for submitting the Appeal

The offender, or other person required to pay the penalty, may appeal to the Prefect of Pisa within 60 days of the dispute or notification of the fine.

The appeal can be presented:

  • Directly to the Prefect (here the contact details) by registered letter a/r. The Prefect will transmit the appeal to the Province of Pisa together with the documents enclosed by the applicant. The competent office will in turn send to the Prefect all the technical elements necessary to decide whether or not the appeal is well founded.
  • Through the Sanctions Office Highway Code of the Province of Pisa by registered letter a/r, certified e-mail (PEC) or ordinary e-mail (here the contact details).

In the formulation of the appeal, the user can also request a personal hearing to the Prefect.

NOTES

  • The appeal to the Prefect sent after the deadline of 60 days from the date of notification of the fine will be declared inadmissible.
  • If the payment of the penalty has already been made to a reduced amount, it is not possible to appeal to the Prefect. The payment involves the acceptance of the fine and is therefore alternative to the presentation of the appeal.
  • If there is an accessory penalty (typically a licence suspension), it is not possible to appeal against this sanction alone, but the report as a whole must be contested.

 What the Prefect is allowed to decide

The Prefect examines the appeal and the attached documents, also evaluating the acts produced by the Command to which the inspection body belongs. After the consultation with any interested person who has requested the hearing, he shall give his decision.

The Prefect may:

  • Declare the appeal inadmissible if submitted after the deadline.
  • Uphold the appeal if he considers that the finding underlying the sanction is unfounded. In this case the Prefect issues a reasoned order for dismissal, giving notice to the Command to which the inspection body belongs, which will in turn inform the claimants.
  • Reject the appeal if he considers that the sanction is well founded and correct. In this case, the Prefect adopts a reasoned order forcing the claimant to pay a certain amount, not less than the double of the minimum for each individual violation and including the payment of costs. The payment of the sum have to be made within 30 days of notification of the order.

NOTES

  • The prefectural order must be issued:
    1. within 180 days if the appeal is submitted directly to the Prefect;
    2. within 210 days if the appeal is forwarded through the inspection body.

After these deadlines, without the Prefect’s decision, the appeal is automatically approved.

  • The order have to be notified to the claimant within 150 days of its issue.
  • Against the payment order issued by the Prefect, the citizen can appeal to the Justice of Peace within 30 days of notification.
